Dominican Airport Shuttles LLC Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the services provided by Dominican Airport Shuttles LLC, a limited liability company registered in Delaware ("we," "us," "our," or "DAS"). By booking or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.1

2. Services

Dominican Airport Shuttles LLC offers the following services (collectively, the "Services"):

• Transportation: Airport transfers, point-to-point rides, taxi services Worldwide.
• Airport VIP Services: Fast Track immigration and customs assistance, access to airport lounges.
• Car Rental with Driver: Provision of a vehicle and a professional driver for transportation Worldwide.
• Tours: Guided tours and excursions Worldwide.

3. Booking and Payment

• Booking: Bookings can be made online through our website (if available), via email at booking@dominicanairportshuttle.com. All bookings are subject to availability.
• Confirmation: Upon receiving your booking request, we will send you a confirmation email with the details of your booking and payment instructions. Your booking is only confirmed once payment is received or a specific agreement is reached between Dominican Airport Shuttles LLC and the client.
• Payment: We accept various payment methods, which may include credit cards, debit cards, bank transfers, and online payment platforms. Specific payment terms will be outlined in your booking confirmation.
• Pricing: Prices for our Services are subject to change without notice. The price quoted at the time of booking is guaranteed once your booking is confirmed and paid for.
• Currency: All prices are typically quoted in US Dollars (USD).

4. Cancellations and Refunds

• Transportation & Car Rental with Driver:
  • Cancellations made more than 24 hours before the scheduled pick-up time will be subject to a mandatory 8% cancellation fee of the total booking amount. The remaining balance will be refunded.
  • Cancellations made less than 24 hours before the scheduled pick-up time are non-refundable.
  • No-shows will be charged the full amount of the booking and are non-refundable.
• Airport VIP Services:
  • Cancellations made more than 48 hours before the scheduled service time will be subject to a mandatory 8% cancellation fee of the total booking amount. The remaining balance will be refunded.
  • Cancellations made less than 48 hours before the scheduled service time are non-refundable.
• Tours:
  • Cancellation policies for tours may vary depending on the specific tour and the third-party provider (if applicable). The specific cancellation policy will be provided at the time of booking.
  • In general, cancellations made 7 days or more prior to the tour will receive a full refund minus the mandatory 8% cancellation fee. Cancellations between 6 days and 72 hours will receive a 50% refund minus the mandatory 8% cancellation fee and less than 72 hours prior will not receive any refund.
• Refunds: Refunds, if applicable, will be processed within a reasonable timeframe, typically 7-14 business days, using the original payment method.

5. Transportation Services

• Waiting Time: For airport pick-ups, our drivers will wait for a maximum of 60 minutes after your flight's scheduled arrival time. For other pick-ups, the driver will wait for a maximum of 15 minutes. Additional waiting time may be subject to extra charges.
• Flight Delays: We monitor flight statuses for airport pick-ups. If your flight is delayed, we will adjust your pick-up time accordingly. Please inform us immediately if your flight is canceled or significantly delayed to another day.
• Luggage: Please inform us in advance of the number and size of luggage pieces you will be traveling with to ensure adequate vehicle capacity.
• Vehicle Type: We reserve the right to substitute the booked vehicle type with a comparable or upgraded vehicle if necessary.
• Child Seats: Child seats can be provided upon request, subject to availability. Please specify your needs at the time of booking. Additional fees may apply.

6. Airport VIP Services

• Fast Track: Our Fast Track service is designed to expedite your passage through immigration and customs. However, we cannot guarantee specific processing times, as these are ultimately determined by airport authorities.
• Lounge Access: Lounge access is subject to the rules and regulations of the specific lounge. We are not responsible for any refusal of entry by the lounge staff.
• Meeting Point: Our representative will meet you at a designated meeting point within the airport. Specific instructions will be provided in your booking confirmation.

7. Car Rental with Driver

• Driver's License: Our drivers are professionally licensed and insured.
• Itinerary Changes: Minor changes to the itinerary during the rental period may be accommodated, subject to the driver's availability and any additional costs. Major itinerary changes may require prior approval and could affect the price.
• Fuel: Fuel is not included in the rental price, unless otherwise stated.
• Overtime: If the rental period exceeds the agreed-upon duration, overtime charges may apply.

8. Tours

• Third-Party Providers: Some tours may be operated by third-party providers. In such cases, we act as a booking agent, and the terms and conditions of the third-party provider will also apply.
• Itinerary: Tour itineraries are subject to change due to weather conditions, safety concerns, or other unforeseen circumstances.
• Physical Fitness: Some tours may require a certain level of physical fitness. Please ensure you are aware of the physical requirements before booking.
• Insurance: We recommend that you have adequate travel insurance that covers medical expenses, trip cancellations, and other potential risks.

9. Lost and Found

• Reporting Lost Items: If you believe you have left an item in one of our vehicles or during the provision of our services, please contact us immediately at info@dominicanairportshuttle.com with a detailed description of the item, the date and time of your service, and your booking information.
• Efforts to Locate: We will make reasonable efforts to locate and return lost items. However, we cannot guarantee that any lost item will be found.
• Retrieval: If a lost item is found, we will contact you to arrange for its retrieval. You may be responsible for any shipping or delivery costs associated with returning the item.
• Unclaimed Items: Unclaimed items will be held for a period of 30 days. After this period, unclaimed items may be donated to charity or disposed of at our discretion.
• Liability: Dominican Airport Shuttles LLC is not responsible for any loss or damage to items left in our vehicles or during the provision of our services.

10. Liability

• Limitation of Liability: To the fullest extent permitted by law, Dominican Airport Shuttles LLC shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses,2 resulting from: (i) your use of or inability to use the Services; (ii) any unauthorized access to or use of our servers and/or any personal information3 stored therein; (iii) any interruption or cessation of transmission to or from our Services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third4 party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the5 Services; or (vi) any loss of personal belongings, lost items, or valuables during the use of our service.
• Force Majeure: We shall not be liable for any delay or failure to perform our obligations under these Terms due to events beyond our reasonable control, including but not limited6 to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents,7 strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.8
• Indemnification: You agree to indemnify and hold harmless Dominican Airport Shuttles LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys'9 fees) arising out of or relating to your use of the Services or your violation of these Terms.10

11. Passenger Conduct

• Passengers are expected to behave respectfully towards our drivers, staff, and other passengers.
• We reserve the right to refuse service to any passenger who is deemed to be under the influence of alcohol or drugs, or whose behavior is disruptive, abusive, or poses a safety risk.
• Smoking is prohibited in all of our vehicles.

12. Governing Law and Dispute Resolution

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the11 State of Delaware, without regard to its conflict of12 law principles.
• Dispute Resolution: Any dispute arising out of or relating to these Terms or the Services shall be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation13 within 30 days, it shall be submitted to binding arbitration in Delaware, in accordance with the rules of the American Arbitration Association.

13. Amendments

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting14 on our website or otherwise notifying you.15 Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.

14.16 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck from17 the Terms and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between18 you and Dominican Airport Shuttles LLC regarding your use of the Services and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written,19 between you and us.
